Abstract

In a further reformation of the modern Russian society the problem of building the welfare state extends to actual ones. In modern Russia the process of creation and organization of functioning of the welfare state are contradictory and not consistent. The study of the problem of the welfare state requires a highly independent comprehensive study of this problem through the prism of the theory of law modern Western countries, as well as the practical realization of their constitutional provisions. Assessing foreign experience of formation of the social state as a theoretical concept and as a practice, it should be noted that it is superior to the domestic. The process of development of state and law in the West can be described as the process of forging of the concept of the welfare state and its subsequent political and legal implementation.
