Abstract

The article analyzes transgression and arbitrariness as volitional and purposeful acts of violation by political elites of the boundaries permitted by the general regulatory system of this society. Transgression is seen as a violation of all sorts of boundaries, including intra-elite ones. We can talk about moral transgression, civil transgression, etc. The degree of this kind of action can be different - from rebellious (violation of the rules in the name of the new), to subversive (aimed at changing the elements of the system). Arbitrariness is related to ignoring prohibitions external to power groups (including general civil codes), but it is mostly oriented towards the internal norms of the elite community “operational code”, “private public law”. Elites have certain self-restraints associated with the desire to preserve themselves as a whole. Such phenomena as political scandal, elite paradox, legal arbitrariness, moral order are also analyzed.
