Abstract

The article examines the problem of self-employment from the point of view of assessing the level of social and labor rights and guarantees within the framework of this form of involvement in the labor sphere. The relevance of this formulation of the question is confirmed by the fact that the scaling of self-employment, due to the favorable regime of the tax on professional income, is accompanied by an interest in the system of its regulation from the point of view of economic, tax and organizational, but not social and labor aspects. The article examines the scale of self-employment and reveals contradictions between Rosstat data and other sources, which indicates the need to adjust the methodology of the corresponding labor force surveys. The structure of self-employment is analyzed according to the criteria of attitude to the main job, status, as well as other criteria (demographic, professional, industry). The results of the author's analysis of the characteristics of the self-employed based on the RLMS data are presented. The ratio of self-employment with overlapping forms of employment, including freelance, platform employment, and agency work, is considered. The problem of substitution of self-employment for actual labor relations is considered. Recommendations for the regulation of social and labor aspects of self-employment in the framework of a special law on self-employed, the pension insurance system and other guarantees for self-employed are substantiated.
